Two (or more) people having vaguely similar (or even identical) designs for their OC doesn’t break any state laws or site rules. Especially when you’re basing your OC on something you created in Pony Town.

I have never used Pony.town, and I’m not 100% sure what it is. The oldest thing I have with Ruby is from last November, which was some character generator stuff. I don’t know your character and until you started badgering me I’ve never even knew it existed.
And to prove is…
I have no phote with my oc and a date but look at the hair style and the colour of fur and mane.
You need more then just saying ‘because’ to prove this. Do you have anything to prove that this is a copy of your OC, can you even prove the guy who owns even uses your service because I know I’ve never heard of it before.
Right now if you really think this is the case report it to the admins, because for now all your doing is making a scene.
He knew me because I have talked to this oc and this two picture break some laws of Germany.
When you ask he live not in Germany it’s right.
But haven’t read the rules of derpibooru.

Look, if he never knew you, and never saw your OC drawn, and you have zero pictures of your OC, and yet you met this person who looked almost exactly like you in a video game where you can’t view anyone else’s files prior to character creation…
…is it fair to say one might have no clue your OC exists in the form it does? That this person didn’t steal your OC but created something perceived as unique because he’d never seen it before?

I saw this other OC but he didn’t ask me that he could use it.
New account… Do you have anything of your OC that could even been found or seen to steal? If there’s never been anything posted with them before how could it be your character?

There’s only so many colors that can be used when it comes to a ponysona, you’re almost always bound to find someone that has a similar OC to your own.
So yeah, it’s not your OC. His name is Ruby Facet and its owned by the lovely gentleman that commissioned me.
