The matter is a little more complex than that. No, it is much more complex, the more I think about it.
Are Derpibooru’s servers located in a EU member state? If not, then the staff isn’t obliged to ban any users from Europe or to prevent them from uploading MLP: FiM fanart. Derpibooru, just as any other site on the Internet, only operates under the law of the country its servers are located in. If its servers aren’t in a EU country or if the staff would move servers into a country outside of the EU, Derpibooru can’t be bothered with anything.
And that only goes if Hasbro even wants to cut off european users from MLP: FiM fanwork, which it doesn’t. Article 13/17 or not, the decision to demand money from sites that host copyright-protected content is still made by the copyright holder.
Hasbro has always been fanwork friendly, so it will neither ask Derpibooru, nor FIMFiction to pay money.
