After the resolution of upload filters and ancillary copyright in the EU parliament, there are hail of protests. However, GEMA sees its requirements fulfilled.
 
The EU Parliament’s Legal Committee’s “yes” to upload filters on online platforms for user-generated content and to a five-year ancillary copyright on the Internet has triggered a wave of criticism. The Bundesverband der Verbraucherzentralen (Federal Association of Consumer Centers) complains that the committee has “bowed to the pressure of the creative and publishing industries”. This would have “immense negative consequences on how we communicate with digital content”. Fearing “completely unclear liability rules”, many contents are likely to disappear from the Internet.
 
Instead of serious news, “Fake News” could spread even more easily on the Internet under these circumstances, fears the VZBV. It was particularly bitter that the parliamentarians did not provide for effective measures for users to “reappear on the platform” when content was wrongly deleted.
 
The German Digital Economy Association (BVDW) also warns of far-reaching effects on network culture and freedom of opinion on the Internet. In their opinion, the rules should - similar to the Network Enforcement Act in Germany - “lead to self-censorship ahead of time”. “The EU is thus massively interfering in the basic technical structure of the Internet and provoking a fundamental change in the values of Internet regulation,” adds the ECO Association of the Internet Economy. A “paradigm shift in the liability of providers” towards a “binding ex ante control and censorship infrastructure” would then follow.
 
A “complete failure” and a step backwards is what Digital Europe, the umbrella organisation, is about in the committee vote. MEPs not only restricted network freedoms, but also prevented a “significant and forward-looking solution for text and data mining”, which would have been essential for innovation and growth in the field of artificial intelligence.
 
“Upload filters are a means of control and censorship in authoritarian states and have no place in democracies,” states the data protection association Digitalcourage. It is negligent to restrict freedom of expression. The ancillary copyright was a lobby project of Axel Springer & Co. The civil rights campaigners see the users as being handicapped: “Anyone who enables access to free knowledge on the Internet, quotes, links, works creatively with texts, images, videos or audios will encounter problems. They have therefore launched an appeal against the core decisions.
 
The next decision will be taken by the EU Parliament in July. The Digitalcourage e.V. appeal to all German MEPs - No to upload filters! I have support their work with a donation of 100 €’s right now. I don’t know if it works, but sometimes you have to do what you have to do.

On 20 June 2018, the European Parliament Committee on Legal Affairs voted in favour of adopting Articles 11 and 13. The vote will then go to the European Parliament in July 2018, while a final vote is set for either December 2018 or January 2019.
 
Eeyup. But until it is presented to EU Parliament in July, it is possible to lodge complaints, formulate protests and mobilise appropriate MEPs. Better to try something now than to wait too long. At least that’s my attitude. The sooner the better.
