not a legal expert, but I did some digging, and here’s my understanding:
If what Chris says is true, then he and Barb have done it twelve times. I don’t know if the charges would stack.
Chris has been
arrested (but not yet charged) for incest. It looks like in Virginia, it’s a Class 1 misdemeanor, and he would be looking at a maximum of 12 months in prison, and/or a maximum fine of $2,500.
Incest aside, if it’s determined that Barb didn’t (and/or couldn’t) give consent, then Chris could be charged with rape under clause (ii).
(ii) through the use of the complaining witness’s mental incapacity or physical helplessness
So he’d be looking at five to life.
He’s also violated his a No-Contact Order. According to my research, the only consequence for this is that the person is incarcerated until their trial. Considering Chris has already been arrested, this seems to be a moot point.
I know that Barb was sent to the hospital for a wellness check. I feel like if Barb was sexually assaulted and she has dementia, the wellness check will confirm both of those things. Between that and what Chris has said, there should be enough for a conviction. I doubt Chris will end up in a regular prison; he’ll probably be sent to a mental institution.
