Yeah. You don't have to 'prove' someone is gay. You just fire them for the reason that they are homosexual. And then good luck to them working again.
It's only been [illegal to fire someone for being homosexual for 2 years](https://www.aclu.org/news/lgbtq-rights/supreme-court-says-firing-workers-because-they-are-lgbtq-is-unlawful-discrimination) in the US. But it's in the big bucket of cases that the conservative court is looking to readjudicate.
