The Supreme Court basically just said that America is a Republic until it suddenly isn’t anymore.
The EPA ruling has effects well beyond itself today. Broadly speaking, this ruling is far worse for administration than it is for the environment, given that coal and oil fire power plants are dying anyway.
The big issue is that the court just threw a wrench in 110 years of administrative law, questioning the governments ability to delegate to its internal agencies.
For example, this effectively will strip the FCC of its authority to ensure fair internet access, as it was not specified in the fonding charter or subsequent iterations of its specifically delegated power. Everything the FDA may no longer have the power to keep certain toxins or targeted chemicals out of food without specific authority from Congress.
This ruling has the potential to grind the very apparatuses of our government to a grinding halt, and people will suddenly understand why it was all important in the first place.
