You don’t have to “enforce” the ban or actually prove anything in court, just arrest people on “suspicion”, publicly humiliate them, keep them in lock-up for some hours, and for the people you really don’t like, press charges so it goes to court and they have to pay bail (or sit in jail) before the case is dismissed.
It’s a cudgel with which you can deal with problem-makers and uppity folk that protest too much, and creates a nice comfy aura of fear that drives the degenerates away from your county/district/state.

The Supreme Court basically just said that America is a Republic until it suddenly isn’t anymore.
The EPA ruling has effects well beyond itself today. Broadly speaking, this ruling is far worse for administration than it is for the environment, given that coal and oil fire power plants are dying anyway.
The big issue is that the court just threw a wrench in 110 years of administrative law, questioning the governments ability to delegate to its internal agencies.
For example, this effectively will strip the FCC of its authority to ensure fair internet access, as it was not specified in the fonding charter or subsequent iterations of its specifically delegated power. Everything the FDA may no longer have the power to keep certain toxins or targeted chemicals out of food without specific authority from Congress.
This ruling has the potential to grind the very apparatuses of our government to a grinding halt, and people will suddenly understand why it was all important in the first place.

It’s the right decision. Delegation is fine, but the power of these bureaucratic agencies should be clear and limited to what was delegated to them. They are not the congress, they act on what specifically was assigned to them, as a result if they want to act beyond that it is Congress who would delegate that, as our elected body.

Yeah, I don’t, but I have close family working in the federal government so I am well acquainted with the limitations of it. The court did not decide that congress can’t delegate broad regulatory power at all, however it did reiterate that if the agency wishes to flex those powers they need to be able to point specifically where this authority comes from.

I’ll put my firsthand experience up against your secondhand understanding any day.
Powers which are often subject to interpretation because there is no mandate that can spell out every aspect of specifically delegated powers.
My position alone has hundreds of duties, many of which are based on interpretations of specifically delegated duties given to my department, which itself has interpretated duties and functions from our various mandates, memorandums, and policy papers. Departments all function with a degree of assumed authority and autonomy, it keeps the bureaucracy from becoming the parody of itself in Futurama.
This ruling is so broad that even specific functions of specific departments might be opened up to having to get congressional approval to even basic things unless it is specifically and boldly stated.
And I’m sorry that just will not work.

That the EPA does not have the authority to cap gas emissions from power plants. Despite it being an implied power for, you know, the agency empowered to protect the environment and natural resources of our country.
It all rests in a very shaky legal doctrine that relies on specific delegation over assumed or informed delegation. The latter two is how a vast majority of the federal government functions.

Because this wasn’t even a lawsuit brought by owners of power plants or energy companies, it was brought by the dying shithole that is West VA, desperately trying to keep coal from dying even though most new power plants are moving away from it, and most companies have little appetite to expand coal and oil consumption over cheaper natural gas and renewables.

But that’s not what this ruling says. It’s fine if you have firsthand experience with the federal government, but in this case I’m questioning your legal understanding of the ruling. Their isn’t a problem here with Congress delegating duties to regulatory agencies, in fact in the court’s decision they made that clear. What the courts did was followed the major questions doctrine. At a certain point broad regulatory direction of Congress could be read to mean anything, and a regulatory agency can go nuts to where they are, from a practical standpoint, legislating. At a certain point a regulatory agency does something much more transformational and it falls into the realm of Congress. The Court wants to see where in their delegated powers they can do this, and the EPA’s argument fell flat.
This was not to say that any regulatory agency can’t have broad regulatory powers, but instead it’s taking the common sense stance that at a certain point the actions of a regulatory agency are so big and significant that they do need to either show specifically why they have this power and if they can’t they need to be granted it by Congress.

Seeing how slow congress it, and how pro-corporations they are due to lobbies and the like, I see this going south real quickly.
If you saw someone poisoning food, you don’t get the CEO to taste-test it. You get the manager to look into it. The FDA is the manager, and congress are the CEOs who are nowhere near this.

Again though, the power of the agency is derived from Congress. Congress delegates it to the agency, how can we say the agency has that power when Congress is unwilling to give it to them? People like to preach how important democracy is, but this solution would be to give the power to a group of unelected individuals who our democratically elected individuals are not giving the power to.

Where it is defined (ex: Georgia) this ‘crime against nature’ has been legally defined as ‘any sexual act involving the sex organs of one person and the mouth or anus of another’.
