How can you read the report and come to that conclusion?
The Muller report concluded - in very simple terms - that Trump corruptly exercised his powers to obstruct justice.
Barr believes the President can not violate the law, because he is the highest Federal legal authority. So while the report found multiple instances of criminal activity, Barr concluded that they are not chargeable offenses, because he believes a sitting president can not be indicted except by Congress.
Also, the special counselor was instructed by the justice department to “not to apply an approach that could potentially result in a judgment that the President committed crimes”. So they were specifically instructed by the AG to not make any judgements about whether the President committed crimes - all they could do was findings of fact, which included multiple instances of criminal, and in any other instance indictable, behavior.
Instead, the SC reached “The conclusion that Congress may apply the obstruction laws to the president’s corrupt exercise of the powers of office accords with our constitutional system of checks and balances and the principle that no person is above the law,” – the Muller report.
So, the report concluded that laws were broken, but only congress can indict, because the AG has ruled that a sitting President is, in their judgement, above the law. Congress now has the opportunity to decide whether the President is above the law or not. There is literally no precedence for this, because Nixon resigned before the question could be answered.
The report also concludes that after Trump leaves office, prosecutors could re-examine the evidence which could “potentially result in a judgment that the president committed crimes.” Because then as NOT a sitting President he would no longer be above the law.
There is evidence sufficient to indict anyone except for the sitting President during a time when the AG has decided that sitting Presidents can’t be indicted by his department, so once Trump is no longer a sitting President, the AG won’t be able to protect him.
So the dozen ongoing investigations that were spawned by the Special Counsel will continue to grind their wheels, and Congress will now decide whether to apply “checks and balances”.
