If he was using the design but changing her name then he’d be stealing the design, but since everything about his art of her is basically the same, look, name, personality(to an extent), it’s just straight up the character themselves he’s drawing, not stealing the design. So it is technically fan art, but failing to correct people when they assume he’s the creator is definitely a point of contention, but we can help fix that by informing people of their incorrect assumption and calling him out if he continues to.  
Anyway, as @Derpy Whooves said, no more talking about it here, do it in the forums.

For this site, the OC’s tag says it was designed by s-ansy, and I don’t see anyone claiming otherwise. And we don’t have a clear statement from the creator saying that images using their OC are a problem. If you have examples of someone else claiming that they own this OC on this site, or if you see anyone doing what you believe breaks our rules, please report it.
 
Otherwise, this art is not breaking any of our rules. If you think our rules need to be changed, the Site & Policy forum is the place to discuss it, not fanartist’s comment threads.

im not sure what the difference is. fanart is not the same thing as taking the oc and posting multiple pictures pretending its your own. which is what happened.
 
the intent of the post is not clear, she said fanart is fine but not to use her design which puts it in a gray area, but i dont see it as cut and dry to be permission to do what was done.

Reread, it says to not use the designs, whereas for the question “Can I draw your OC?” it says it’s fine.

Judging from what S-ansy’s profile says on DA, she’s more than likely absolutely fine with the porn of SG, since she’s a bit of a pervert herself.  
So I think, so long as people encourage Shino to inform people that he isn’t actually the creator of SG, and help remove the misinformation elsewhere, then everything will be fine and nobody’s feelings will get hurt.
 
On a positive note, I do like sleepy pones, and this OC, so I may even draw her myself at some point, though whether or not it’s in an explicit scenario is yet to be decided, since she’s quite literally a ponysona of s-ansy rather than just a character.

As stated in several places on our site, including our FAQ and Takedown Requests procedure, OCs are not subject to copyright.
 
Instead, as we have with this OC, we have noted who the creator of the OC was on the character’s tag, and if we have any indication that a piece of art involving someone else’s OC is an attack piece, then we will approach it as a Rule #0 violation.
 
But we have no information from the creator saying that they don’t want others to make art of their oc, either here on this site or on any sites where they have a presence, and none of this art appears to be anything other than a celebration of the character.
 
If people have specific complaints about this image, or feel that it or other work using this OC is violating our rules or some sort of personal attack against someone else, please report it.
 
And if you have any questions about how we handle OCs or situations like this where someone is making art of a character that someone else designed, please create a new thread to discuss it in our Site & Policy forum, or send me a PM if you would rather not talk about it publicly.
 
Beyond that, it’s not very respectful to artists to be using their artwork comment threads to discuss meta issues such as these. Please keep your comments apropos the image itself, and if you want to continue this discussion please do so somewhere else.
 
2LDR: There’s no rules being broken here, we have no indication of any kind that there is any problem with this artist making art of this character, and this discussion really has gone on long enough. If you don’t have anything substantial to add via a report or a post in the Site & Policy thread, then please drop it.

There’s a perfectly understandable reason to be upset about it, Is the original owner even aware of her OC being used in porn?  
As far as I remember, she never used her in porn before, and multiple times people have told Shino “this is your OC” or “nice OC” and he has never corrected them. That’s very strange behavior for someone being ‘reasonable’ anyway.
 
Just because she hasn’t been around, it’s no excuse to co-opt a character she created (as a representation of herself, mind you) and use her however one pleases, what kind of argument is that?

i was unaware pizza pony belonged to someone else. if he stole that also then i would be annoyed by that. that is literally what he is doing right now, nobody knows this oc belongs to someone else so of course nobody cares. had he told people it wasn’t his oc then it would have been a lot more obvious.

My general feel is to leave this to the artists… No reason to get upset about it here!
 
If the original artist has an issue I’m sure they’ll be able to work it out with Shino, he’s very reasonable.
