I’m not a lawyer and can’t give legal advice, but I doubt Sunburst would be able to be convicted without a mens rea, meaning a state of mind of committing a crime.

Probably because both of them would have gone to jail otherwise, regardless of the guilty party.

Though my question is why he wanted her to keep quiet on the issue when he was the victim.
