Entirely depends on the case and the means in which the content is being utilized. If it’s something like a show or movie or game which is meant to be given to the public, you can just request for the production to end, and any further production can not only be punishable, but easily monitored.
Fanfiction and pictures and toys, however? Well, heck, have you been to a convention hall? There’s people all OVER who make money off of those things! Heck, artists get on-the-fly commissions AT the events! It’s not like Hasbro can do anything about those when they’re all over and so quick to make. The most they can do is present a C&D to something being manufactured, like those naked “body pillow cover ponies” in the past. Even THEN, they’re still around, and can be purchased and made in secret, as it’s for individuals rather than something presented entirely for the public.
THAT SAID… They still “sorta” made Fighting is Magic based around someone swiping and using the data, and no case was taken to court, so there’s plenty of loopholes in a C&D that can be exploited, too, and JanAnimations is back to making, well, animations involving Button Mash, so a C&D improperly issued CAN be dropped easily enough!
Again, it entirely depends on exactly what is being “made” and “ceased”.

It’s kinda like streakers at sporting events: They’d rather just pretend they don’t exist and not bring attention to them. In fact, “porn of copywritten characters” is actually a subject that remains far from the mainstream, but lawsuits would draw attention to these artists (something they can certainly benefit from), not to mention a simple C&D couldn’t stop them from making it.
They can just say “Hey, want a portfolio of art sent PRIVATELY? Pay and we’ll send it! If you post it, it’s not our fault ‘cause it’s whatever you want to do with the art!”.

Yeah, I’ve made that theory as to why Hasbro apparently turn a blind eye on this kind of stuff. It’s probably for the better, even if they don’t approve.

Because those can be mistaken for the original product (depending on the project of course, but most of the C&Cs that have been given out are for projects that could plausibly be used in an MLP product, like a fighting game with no blood). Porn cannot.
Yeah, Hasbro REALLY wants to sue all those porn artists, thus giving them publicity and ruining the PR they have so lovingly crafted since apparently they are so pretty as to pick fights with smut-folios.
Okay, enough sass. It’s more work to get rid of it, easier to keep around and just ignore.

Inkbunny, in my experience, is worth registering with. Ambris isn’t the only good artist with more content there. There’s a link to the google docs pay interface, but without going to the Inkbunny site you won’t see the instructions so I don’t think it best to post it here.
So, anyway, I’m going to assume the CMC are teenagers here because of the somewhat-developed breasts. That at least soothes my perverted mind a tiny bit.
