I’m aware that universities and colleges everywhere push this idea that the consumption of alcohol forfeits the ability to express consent. It doesn’t, in the eyes of the law, but it’s a good idea to put in the heads of young people who are attending parties where alcohol is consumed.
 
Where alcohol is considered to void expression of consent is if the alcohol was used with a premeditated determination to force sex. This is usually reinforced by one party remaining sober, but not always. Determining premeditation is the challenge.
 
Shino has certainly left enough room to set up Jet as having done this. Delta seems to view it that way, but her bad attitude isn’t a good way of determining facts because she’s bitter about a great many things that she blames him for. He’s a loving father to Apogee and he genuinely worries about Delta, which leads me to believe getting her pregnant was not intentional.

You’re taking my words and twisting them. You haven’t provided any evidence to your side, and have failed to see how Delta agreed to get drunk, have sex, and knew the possibilities around that.
 
Do you have sex and fully consider that your partner can get pregnant? I know I did. Both of us were sober at the time, too. She didn’t want me to use a condom, and I didn’t either. I don’t have a kid today because I was paying attention.
 
The point is that both of them would be irresponsible for not considering all the possibilities.
 
You have a bias for females because you assume they can’t make decisions like getting intoxicated and knowing this impairs judgement. One of the first things I consider when someone wants to go drinking.
 
I couldn’t imagine taking away someone’s freedom like that.

Delta texted Jet. She still has his number, and at the very least Jet has not changed his number. Nor have either of them attempted to go through with a restraining order.
 
These two don’t hate each other. If they did, they’d stop talking to one another and break contact, like any normal person/pony. Both of them have their reasons, none of them good. They love each other, more than likely, but are sitting in their own forts on hills to see the valley between them.

Apogee has no agency. Jet is the one who has his lawyer arrange that. Without her father, Apogee would never have gotten this new arrangement as long as she’s a minor. Jet was also the one to plant the idea and encourage it. As well as allow it in the first place. He could have told her “your mother doesn’t want me around and she’ll feel like I’m using you to keep interfering with her life”. And he knows from Diamond that she said that. And he’s doing it anyway despite the real risk that Apogee might get hurt.

Some fics were made by authors who talked to Shino about the greater story. That doesn’t make them canon. It does make their stories more authentic though. This is why Trash isn’t canon yet.

I should remind you that the arrangement to have Apogee with Delta two days a week was Apogee’s idea, not Jet’s. He even asks her if she really wants to do it.
